The State Board of Medical Examiners has issued a revised Standard of Care that specifically addresses this issue.
If individuals have received a recommendation without warrant, their license will not be renewed under the new policy revisions.
Should suspensions of current medical cannabis licensing be solely at the discretion of DPHHS?

The DPHHS is not made up of physicians. It is part time employees. These people are good at their jobs but they are NOT doctors and have NO qualifications to determine medical conditions. Their jobs are to push paper and detect fraud.
ReplyDeleteI don't see how the DPHHS is qualified to be the ones to determine whether or not what a licensed physician reccomended is right? Are they going to double check every single application? It seems a bit unrealistic to me considering how behind they already are with everything. I think if the DPHHS wants to suspend a medical cannabis license their should be a mutiple tiered process. It shouldn't just simply be up to the DPHHS. I think it should go back to double checking and verifying things with the physician they saw.
ReplyDeleteUnder no circumstance should the DPHHS have the say in this, there are much better ways they should be spending their time starting with their current backlog.
ReplyDeleteNo, obviously no! As has been stated, the MT DPHHS is a paperwork/processing department, not one of medical licensing. Does the MT DPHHS oversee any other type of medicine being used in the state? Get Real!
ReplyDeleteThe DPHHS and Montana Board of Medical Examiners have NO right to intrude into the constitutionally-protected doctor-patient relationship. This is one more attempt by government entities to infringe on our constitutional rights. Regardless of where you stand on the medical marijuana issue the overlying right to privacy surrounding the doctor-patient relationship should be vigorously defended by montanans at all costs.

No.. I think that if the State DPHHS has an issue with a renewal, they should have a medical Dr. on call to evaluate the situation.
